All Quotes, SoW and Scope of Work are valid for thirty (30) days from issue unless otherwiseagreed or stated.
This is a Scope of Work (quote) estimate is based on the brief as described and our understandingof the brief. Any changes to the brief or production requirements may incur differences in costs,any increases or reductions in costs will be reflected in the final invoice and/or an updated Scopeof Work (quote). Please note, updates or amendments to the scope may affect timings and finaldelivery of services or assets.
Acceptance of any financial quotes received from BRICKOVEN and/or the issue of a purchaseorder from the client to BRICKOVEN, is acceptance and agreement of the Terms and Conditions inthis document
Unless agreed otherwise in writing, BRICKOVEN reserves the right to request 40% to 75% of thetotal invoice amount, dependant on project total budget size (as a deposit) at least fourteen (14)days prior to commencement of any work. If there is less than 14 days between receiving theinvoice and the agreed project start date, the deposit must be paid immediately. The remaining60% or balance shall be invoiced on the day that the project completes or first draft still or videois received by the client.
Overdue payments will incur a statutory interest charged at 8% of the invoice total plus the Bankof England base rate (currently 1.25%) and a recovery fee (Up to £999.99 - £40 recovery fee /£1,000 to £9,999.99 - £70 recovery fee / £10,000 or more- £100 recovery fee) as per governmentguidelines and legislation, at the discretion of BRICKOVEN.
In the event of cancellation of a service or termination of the agreed contract, in whole or part, bythe client prior to completing the project, BRICKOVEN reserves the right to make the followingcancellation/termination charges:
i. Cancellation by the client with more than 48 hours notice before a production has commencedmay result in a charge being made to cover costs already incurred.
ii. Cancellation by the client with less than 48 hours notice may result in up to 50% of total chargeminus any deposit paid.
iii. Cancellation by the client when the production has commenced, or with less than 24 hoursnotice, may result in up to 100% of the total charge being made.
BRICKOVEN reserve the right to cancel or terminate a contract or agreed project if:
i. You or your organisation becomes insolvent or subject to bankruptcy proceedings.
ii. The reputation of BRICKOVEN and anyone connected with BRICKOVEN could be damaged.
The client may terminate the contract at any time by written notice of termination, and onsettlement of account. When the client terminates the contract, they will remain liable to pay infull for all work previously undertaken and in progress by BRICKOVEN unless any other writtenagreement is reached in advance.
This includes any creative and/or pre-production activity prior to productioncommencement/video or still shoot. The cost of pre-production will have been agreed as part ofthe quote and is non-negotiable.
